Membership Agreement

Please read these Terms carefully before registering, making payment, or using Freelance Maker services.

These Terms & Conditions (“Agreement”) constitute a legally binding agreement between Freelance Maker (“Company”, “We”, “Us”, or “Our”) and any individual or business (“Member”, “User”, “Freelancer”, or “You”) who registers for, subscribes to, or uses any service provided by Freelance Maker.

By registering, making payment, submitting documents, accepting projects, or accessing our services, you confirm that you have read, understood, and agreed to be legally bound by these Terms & Conditions.

1 Nature of Services

Freelance Maker is a lead generation, networking, and project facilitation platform for creative professionals. Our services may include, but are not limited to, exposing projects to:

  • Makeup Artists (MUA)
  • Mehandi / Mehendi Artists
  • Photographers
  • Videographers
  • Reels / Content Creators
  • Graphic Designers
  • Video Editors
  • Album Editors
  • Other creative professionals approved by the Company

Freelance Maker does not employ Members, create an employer-employee relationship, or act as an agency guaranteeing work. The Company only provides introductions, project information, networking opportunities, and lead services.

2 No Guarantee of Projects or Income

The Member expressly understands and agrees that:

  • Membership does not guarantee projects.
  • Membership does not guarantee earnings or fixed income.
  • Membership does not guarantee client responses.
  • Membership does not guarantee a minimum number of leads.

Project allocation depends entirely on client requirements, Member performance, location, availability, professionalism, competition, and business demand.

Failure to receive projects shall not constitute a breach of this Agreement.

3 Membership Approval

Freelance Maker reserves the absolute and sole discretion to:

  • Approve or reject any application.
  • Suspend membership.
  • Terminate membership.
  • Refuse future registrations.

The Company is under no obligation to disclose the reasons for its decision.

4 Mandatory Identity Verification

For security, quality control, and fraud prevention, the following professionals must submit a valid Government-issued ID proof:

  • Photographers
  • Videographers
  • Album Editors
  • Video Editors

The Company reserves the right to request additional documents whenever necessary.

Submission of forged, altered, or misleading documents shall result in immediate termination without refund.

5 Interview & Skill Assessment

As per Company policy:

  • Applicants may be required to attend an interview.
  • Interviews shall be conducted by the respective Project Coordinator or authorized representative.
  • The Company may conduct skill assessments, portfolio reviews, background verification, or professional evaluations.

The Company’s decision regarding approval or rejection shall be final and binding.

6 Project Allocation

Project allocation is entirely at the discretion of Freelance Maker, clients, project coordinators, and related factors including your pricing. Allocation may depend on:

  • Experience
  • Portfolio quality
  • Skill level
  • Professional conduct
  • Availability
  • Client preferences
  • Geographic location
  • Ratings & previous performance
  • Timely communication

7 Member Obligations

The Member agrees to:

  • Provide accurate information at all times.
  • Maintain professional behavior.
  • Deliver services ethically.
  • Respect client confidentiality.
  • Maintain high service quality.
  • Meet agreed deadlines.
  • Avoid misleading advertisements or false claims.
  • Cooperate with Company coordinators.
  • Comply with all applicable laws.

Members shall be solely responsible for their own taxes, licenses, registrations, insurance, equipment, transportation, and business expenses.

8 Payments

All membership fees, registration charges, onboarding fees, subscription fees, verification charges, or service fees paid to Freelance Maker are solely towards access to our platform, lead generation, verification process, networking opportunities, administrative services, and business development support.

Such payments are not payments for guaranteed employment, guaranteed projects, or guaranteed income.

9 Strict No Refund Policy

All payments are final, irrevocable, and non-refundable.

The Member expressly waives any claim for refund, reversal, chargeback, adjustment, or compensation.

No refund shall be granted under any circumstances, including but not limited to:

  • Failure to receive projects
  • Dissatisfaction with business volume
  • Personal reasons / relocation
  • Lack of availability / illness
  • Business closure
  • Membership cancellation
  • Suspension or termination
  • Failure to attend interviews
  • Failure to complete verification
  • Non-usage of services
  • Client cancellation
  • Delay in project allocation

Members are advised to fully understand the nature of our services before making payment.

10 Chargebacks & Payment Disputes

The Member agrees not to initiate any chargeback, payment reversal, or unauthorized payment dispute after successfully purchasing any membership or service.

Where a Member initiates a chargeback without valid legal grounds, Freelance Maker reserves the right to:

  • Suspend all services immediately.
  • Permanently terminate membership.
  • Recover legal costs, administrative expenses, banking charges, and collection costs.
  • Initiate appropriate legal proceedings where permitted by law.

11 Independent Contractor Relationship

All Members remain independent professionals. Nothing in this Agreement shall be interpreted as creating:

  • Employment
  • Partnership
  • Joint Venture
  • Agency
  • Franchise
  • Employer–Employee relationship

Members shall be solely responsible for services rendered to clients.

12 Client Disputes

Freelance Maker shall not be liable for:

  • Client dissatisfaction
  • Payment delays
  • Project cancellation
  • Service quality disputes
  • Contract / copyright disputes
  • Property damage / personal injury
  • Loss of business or reputation
  • Financial loss

Any dispute between a Member and a client shall be resolved directly between those parties.

13 Intellectual Property

The “Freelance Maker” name, logo, branding, website, documents, content, marketing materials, and business systems are the exclusive intellectual property of Freelance Maker.

No Member may copy, reproduce, distribute, modify, or use any Company material without prior written permission.

14 Confidentiality

Members shall keep confidential all information relating to:

  • Clients & leads
  • Pricing
  • Internal processes
  • Business strategies
  • Project information
  • Coordinator communications

Unauthorized disclosure may result in immediate termination and legal action.

15 Suspension & Termination

The Company may suspend or permanently terminate membership without prior notice for reasons including, but not limited to:

  • Fraud / fake ID
  • Misconduct
  • Client complaints
  • Harassment / abusive behavior
  • Defamation
  • Non-cooperation
  • Breach of Company policies
  • Criminal activity
  • Damage to Company reputation

Termination shall not entitle the Member to any refund or compensation.

16 Limitation of Liability

To the maximum extent permitted by applicable law, Freelance Maker, its owners, employees, coordinators, affiliates, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, business opportunities, data, reputation, goodwill, or income arising from or related to the use of our services.

The Member agrees that any liability of Freelance Maker, if established by a court of competent jurisdiction, shall be limited to the amount of membership or service fees actually paid by the Member for the specific service giving rise to the claim.

17 Indemnification

The Member agrees to indemnify, defend, and hold harmless Freelance Maker, its owners, employees, coordinators, affiliates, and representatives from any claims, losses, damages, liabilities, legal expenses, costs, penalties, or demands arising from:

  • Breach of these Terms.
  • Negligence or misconduct.
  • Violation of law.
  • Client disputes.
  • Intellectual property infringement.
  • Misrepresentation.
  • Services provided by the Member.

18 Force Majeure

Freelance Maker shall not be liable for delays or failure to perform due to events beyond its reasonable control, including natural disasters, pandemics, strikes, internet failures, government actions, war, civil unrest, cyberattacks, or technical outages.

19 Amendments

Freelance Maker reserves the right to amend these Terms & Conditions at any time. Continued use of the services after such amendments constitutes acceptance of the revised Terms.

20 Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.

21 Entire Agreement

These Terms & Conditions constitute the entire agreement between Freelance Maker and the Member and supersede all prior communications, representations, or understandings, whether oral or written.

22 Acceptance

By registering, making payment, submitting documents, using our services, or accepting any project opportunity from Freelance Maker, the Member confirms that they have read, understood, and voluntarily agreed to these Terms & Conditions without reservation.
